Welcome to Syd’s Fine Art. These Terms of Service (“Terms”) govern your use of sydsfineart.store (the “Website”) and purchases made through the Website.

By accessing the Website, placing an order, or otherwise using the Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website or purchase products through it.

1. About Syd’s Fine Art

The Website is operated by Syd’s Fine Art LLC (“Syd’s Fine Art,” “we,” “us,” or “our”).

Syd’s Fine Art offers original artwork, art prints, reproductions, and other creative products. These Terms apply to your use of the Website and purchases made through it. Other policies displayed on the Website, including our Privacy Policy, Shipping Policy, and Returns or Refund Policy, may also apply to your use of the Website or purchase.

2. Eligibility

You must be legally able to enter into a binding agreement in your jurisdiction to place an order through the Website. If you are under the age of majority, you may use the Website only with the involvement and permission of a parent or legal guardian where permitted by applicable law. We do not knowingly collect personal information from children under 13 through the Website except as permitted by applicable law.

3. Artwork & Product Representation

We make reasonable efforts to photograph and describe our artwork and products accurately. Colors may appear differently depending on device, whether your monitor, phone, computer, tablet, through lighting conditions or display settings. Because our products may reproduce physical artwork, minor variations in color, texture, cropping, dimensions, or appearance may occur between the product shown online and the item you receive. These variations do not necessarily indicate that a product is defective. Measurements, materials, production methods, and other product details will be provided in the applicable product listing when relevant.

4. Product Availability

Products may be offered in limited quantities. We reserve the right to modify, discontinue, or limit the quantity of any product at any time. If a product becomes unavailable after an order is placed, we may cancel the affected portion of the order and issue an applicable refund.

5. Orders & Order Acceptance

When placing an order, you agree to provide accurate and complete information necessary to process and deliver your purchase. Submitting an order constitutes an offer to purchase the selected product or products. Your order is not necessarily accepted until we have confirmed that the order can be fulfilled. An automated order confirmation only confirms that your order request was received. We may refuse, cancel, or limit an order when reasonably necessary, including because of:

  • product availability;

  • an obvious pricing or listing error;

  • suspected fraud or unauthorized activity;

  • inaccurate or incomplete customer information;

  • technical or Website errors;

  • suspected resale or unauthorized commercial purchasing; or

  • circumstances that prevent us from reasonably fulfilling the order.

If we cancel an order after payment has been processed, we will issue an applicable refund to the original payment method.

6. Pricing & Payment

Prices are displayed in U.S. dollars unless otherwise stated. Prices may change at any time. Price changes will not affect an order that has already been accepted and paid for, except where an obvious pricing or listing error requires correction. Applicable sales taxes, shipping charges, and other applicable charges will be disclosed during checkout. Payment transactions are processed through third-party payment providers. Syd’s Fine Art does not directly store complete payment-card information. You represent that you are authorized to use the payment method submitted with your order.

7. Sales Tax

Applicable sales and use taxes will be collected where required by law. Tax amounts may vary depending on the destination of an order and applicable tax rules.

8. Processing, Shipping & Delivery

Orders will be processed and shipped according to the processing and shipping information provided on the Website or during checkout. Any processing or delivery timeframe provided by Syd’s Fine Art is an estimate unless expressly stated to be guaranteed. We will make reasonable efforts to fulfill orders within any advertised timeframe. If an order cannot be shipped within the timeframe represented at the time of purchase, we will provide any notices, revised shipping information, cancellation rights, or refunds required by applicable law. You are responsible for providing a complete and accurate shipping address. If an order is returned to us because an incorrect or incomplete address was provided, additional shipping charges may apply if you request that the order be shipped again. Shipping delays may occur because of circumstances outside our reasonable control, including severe weather, carrier disruptions, transportation interruptions, customs delays, supply issues, or other unforeseen circumstances.

9. Lost, Delayed, or Damaged Shipments

If your order is lost, substantially delayed, or damaged during delivery, please contact us as soon as reasonably possible at: sydneyjonesart@gmail.comWe will work with you and, where appropriate, the shipping carrier to determine the status of the shipment and an appropriate resolution. Nothing in these Terms limits any rights or remedies that apply to you under applicable law.

10. Damaged, Defective, or Incorrect Orders

Please inspect your order when it arrives. If an item arrives damaged, defective, or materially different from what you ordered, contact us at sydneyjonesart@gmail.com within 7 days of delivery. Please include:

  • your order number;

  • a description of the issue; and

  • clear photographs of the item and packaging.

Please retain the original packaging until the issue has been resolved. After reviewing the circumstances, we may provide an appropriate remedy, which may include a replacement, refund, repair, or another reasonable resolution. This policy does not limit rights or remedies that cannot legally be waived.

11. Cancellations

You may request cancellation of an order within 24 hours of purchase by contacting: sydneyjonesart@gmail.comA cancellation request does not guarantee that an order can be cancelled. Once an order has entered production, been prepared for shipment, or shipped, cancellation may no longer be possible. If a cancellation is approved, any applicable refund will generally be issued to the original payment method. This cancellation policy does not limit any cancellation rights required by applicable law.

12. Returns & Refunds

Unless otherwise stated on a product listing or separate written policy, Syd’s Fine Art does not accept returns solely because a customer changes their mind. Certain made-to-order, personalized, or otherwise designated products may not be eligible for return. Products that arrive damaged, defective, or materially different from what was ordered will be handled according to Section 10 of these Terms. Where a refund is approved, it will generally be issued to the original payment method. Any separate return or refund policy displayed on the Website at the time of purchase is incorporated into these Terms and will be honored according to its stated conditions. Nothing in this section limits rights that cannot legally be waived.

13. Intellectual Property & Copyright

All artwork, paintings, drawings, illustrations, photographs, written content, designs, graphics, logos, product imagery, Website content, and other creative material appearing on the Website are owned by Syd’s Fine Art LLC, the artist, or the applicable rights holder unless otherwise stated. Purchasing an original artwork, print, reproduction, or other physical product does not transfer copyright ownership or intellectual property rights to the purchaser. The purchaser receives ownership of the physical item purchased, but does not receive ownership of the underlying artwork or permission to reproduce it. Unless you receive prior written permission from Syd’s Fine Art, you may not:

  • reproduce the artwork;

  • scan or digitally reproduce the artwork;

  • photograph or reproduce the artwork for commercial exploitation;

  • create additional prints or copies;

  • sell or distribute reproductions;

  • incorporate the artwork into merchandise;

  • use the artwork for commercial advertising;

  • use the artwork as a logo, trademark, or brand asset;

  • reproduce the artwork in books, publications, products, or digital goods;

  • modify the artwork for commercial purposes;

  • claim the artwork as your own; or

  • upload, distribute, or sell high-resolution copies of the artwork.

Nothing in these Terms transfers any copyright or intellectual property rights unless expressly stated in a separate written agreement signed by Syd’s Fine Art.

14. Personal & Non-Commercial Use

Unless we provide written permission otherwise, products purchased through the Website are intended for personal, non-commercial use. You may display purchased artwork in your home, office, or other personal space. Purchasing an artwork does not grant a license to use the artwork for commercial advertising, merchandise, resale, branding, publications, packaging, promotional campaigns, digital products, or other commercial purposes. 15. User Content

If the Website allows you to submit reviews, comments, photographs, testimonials, or other content (“User Content”), you retain ownership of your original User Content. By submitting User Content to us, you grant Syd’s Fine Art a non-exclusive, royalty-free, worldwide license to use, reproduce, display, publish, and distribute that User Content in connection with operating, marketing, and promoting the Website and Syd’s Fine Art. You represent that you have the necessary rights to submit the User Content and that your submission does not violate the rights of another person. We reserve the right to remove User Content that we reasonably believe violates applicable law, these Terms, or the rights of others.

You agree to use the Website only for lawful purposes.

You may not:

To the fullest extent permitted by applicable law, Syd’s Fine Art LLC and its owners, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Website or purchase or use of products obtained through the Website. Where permitted by law, this includes losses relating to profits, revenue, data, business opportunities, or other indirect damages. To the extent liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law. Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited.

Syd’s Fine Art is not responsible for delays, interruptions, or failures caused by circumstances beyond our reasonable control.

These circumstances may include natural disasters, severe weather, transportation disruptions, supply shortages, internet or technology failures, labor disputes, governmental actions, or other unforeseen events.

We may revise these Terms from time to time.

When changes are made, we will update the “Last Updated” date displayed at the beginning of this page. Your continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law. The version of the Terms applicable to an order will generally be the version in effect when the order was placed, unless applicable law requires otherwise.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

25. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce that provision in the future.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute arising from these Terms, the Website, or a purchase made through the Website will be handled in a court of appropriate jurisdiction as permitted by applicable law. Nothing in this section prevents a consumer from exercising a legal right or remedy that cannot lawfully be waived.

These Terms, together with policies expressly incorporated into them, constitute the agreement governing your use of the Website and purchases from Syd’s Fine Art. They supersede prior versions of these Terms concerning the same subject matter.
